(February 26, 2004) - (Little Rock-AP) -- Wal-Mart will have to pay an 840-thousand-dollar award to a Benton County couple after the state Court of Appeals affirmed the lower court decision. John and Kelli Kilgore sued the company after a Wal-Mart pharmacy in Siloam Springs gave John Kilgore thyroid medication intended for a woman with the same last name. Her name was on the prescription bottle. John Kilgore's prescription was for a medication to treat strep throat. The Kilgores' suit claimed the medication caused John Kilgore to suffer post-traumatic stress and depression. The appeals court rejected Wal-Mart's arguments that Kilgore gave misleading testimony by saying he paid the monthly 650-dollar cost of his medications when insurance picked up much of the cost.
